Divorce — the process
Filing for Divorce – How the Divorce Petition Works in Munich
Once the year of separation is in sight, the practical question arises: how do you actually file for divorce – and what do you need? The path is clearer than many think. From over 300 proceedings handled, we explain step by step which documents are required, how the petition to the family court works and what to expect.
Quick answer
A divorce is initiated by a divorce petition to the competent family court. Because representation is mandatory in court, the petition must be filed by a lawyer. As a rule, the requirement is the completed year of separation. After receipt, the court serves the petition, clarifies the pension rights adjustment and schedules the hearing.
In brief
- The divorce is filed by a divorce petition to the family court – only through a lawyer.
- As a rule, the requirement is the completed year of separation.
- The key document is the marriage certificate; where there are children, their birth certificates.
- The court handles the pension rights adjustment as a matter of course – usually the biggest time factor.
- In Munich, the competent court is the Local Court (Amtsgericht) acting as family court.
Requirements before filing
Before the petition can be filed, three things must generally be in place: the completed year of separation, the breakdown of the marriage and – in the amicable variant – the consent of the other spouse. Only in the rare hardship case is a divorce possible before the year has elapsed.
More on the year of separation
The actual preparation – advice, gathering the documents, possibly a divorce settlement agreement – can begin at any time so that you can file immediately once the year has passed.
Which documents do I need?
For a smooth process, the following documents should be ready:
- Marriage certificate (original or certified copy from the marriage register)
- Birth certificates of shared minor children
- Details of the date of separation
- Information on both spouses' income (for the procedural value and maintenance)
- Documents on pension entitlements (for the pension rights adjustment)
- Where there is an international element: proof of nationality and foreign certificates, if applicable
A checklist makes the start easier
Not everything has to be complete from the outset. We fill in what is missing together. An initial review in the first consultation quickly shows what your case actually needs.
The process step by step
Draft the petition
We formulate the divorce petition and coordinate it with you.
Filing
The petition is submitted to the competent family court. Often the court fee advance is requested first.
Service
The court serves the petition on the other spouse. In an amicable divorce, that spouse declares consent.
Pension rights adjustment
Both spouses complete questionnaires; the court obtains information from the pension providers. This is usually the longest stage.
Hearing
In the non-public hearing, both spouses are heard in person. The hearing is generally short.
Decree and finality
The court pronounces the divorce. Once the appeal period expires (or both waive appeal), it becomes final.
The competent family court in Munich
For matrimonial matters, the family court at the Local Court is responsible. Local jurisdiction usually lies with the court in whose district the shared minor children have their habitual residence; if there are none, the last shared residence of the spouses is decisive (Section 122 FamFG). For many clients in and around Munich, this is the Munich Local Court (Amtsgericht München). Which court applies in your case we clarify right at the start.
Why a lawyer is mandatory
Before the family court, representation by a lawyer is mandatory: the divorce petition can only be filed by a lawyer. In an amicable divorce, however, one lawyer suffices – the other spouse can consent without their own representation. We handle all correspondence with the court and the other side, prepare the documents and keep track of every deadline.
Prepare the petition properly
A well-prepared petition with complete documents speeds up the whole procedure. Send us your key details – we will tell you what to do next.
Cost and legal aid
The cost of a divorce is based on the procedural value, which is essentially guided by both spouses' incomes and can rise where there are significant assets. Court and lawyer's fees follow statutory tables. Those who cannot bear the cost from their own means may be entitled to legal aid (Verfahrenskostenhilfe). In certain constellations, an advance on procedural costs by the economically stronger spouse may also come into play. You receive a concrete estimate in the first consultation – with no hidden items.
