A court divorce obtained in the EU (except Denmark) is, under the Brussels IIb Regulation, generally recognised in Germany automatically – a special recognition procedure is usually not required. For divorces from third countries, the procedure under § 107 FamFG via the state justice administration normally applies; an exception is the “home-state case”, where both spouses were exclusively nationals of the divorcing state.

Private divorces (e.g. religious repudiation or “talaq”) need particularly close examination and are not recognised in every case. Recognition is, among other things, a precondition for remarriage or status questions in Germany.
